can h1b worker claim first time home buyer credit?

to form for claiming says nonresident alien can not claim. However IRS seems to define h1b workers as resident alien when passing the so called presence test. I should be able to pass the presence test. Can I claim the credit if I am an h1b worker? thanks in advance
