faked marriage?

My wife once talked with a white guy about helping
her get GC by faked marriage.

Can I use such evidence to sue this white guy and my wife as
well?

They have not done such faked marriage. Just planned to
do so.

Should I just wait for them to "marry" then use such
evidence?
