Laid off and 401K

I was working in a big company before. The company matches the 401K and the matched part can become vested after 3 years service. I was laid off after I had been working for the company for 2 year and 11 months and 10 days. Because of the 20 days gap, The company forfeited all the company matched part from my 401K account. I want to know: Can I ask the company to keep the company matched 401K for me? Can I go to court for this and how to fight with the company? Any suggestion? Thanks a lot.
