Did the bank and/or the seller's agent even make the disclosure that the house is free of problem or lien? If not, do they have to make such disclosure by your state law? If not, you are pretty much out of luck in your first claim. At least in New York, the seller can simply concede $500 to relieve himself of the obligation to make any disclosure.
