咨询:买房终止合约,如何拿回定金?

我们签订一个买房合约有以下条款
" if the seller is unwilling or unable to fix the major defects found in home inspection up to the reasonable satisfaction of the buyers before the closing date, then the buyer has right to terminate the contact".

我们做了home inspection after signing the contact, 发现 molds in both attic and garage. 特别 Attic mold 是 so called "black mold" - highly toxic. 我们又发现 seller had a water damage claim last year for about $7000, which was not disclosed to us. 我们相信一个三年新的房子有这些问题说明建筑质量很差, 而且防止mold 代价昂贵,所以决定不买这个房子了. 但是我们代理说我们无论如何也无法要回定金,想向各位咨询以下,有没有我们要求是否合理,有什么方法可以要回定金

Also, are we obligated to share the home inspection report with the seller? We spent extra money to get a detailed mold sample test and air quality test results. Thanks very much for your valuable help!
