You should definite go for a lawyer and make sure you go for a good, aggressive lawyer. Depends on the insurance company responsible for the payment, a good lawyer might be able to fight for a good compensation package for you.

A friend of mine got involved in a minor accident a few years ago and the other party managed to sue for 1/4 million dollar damaga even though the other party simply walk away after the accident. My friend's insurance eventually settle the case with the other party for 100k.
