I am not planning to sue anyone as long as

I can get my earnest money back. Of course I stand to lose my legal fees & title search cost, however I view their mistake as negligence but not intentional fraud. So I am not seeking damage at this time. The problem is, while admitting their mistake, the other party won't release the money.
