formally speaking, it is legal to file two H-1B pertitions at the same time. but experience has shown that doing so often causes confusion to ins and thus possibility of denial of both - remember you are dealing with the bureaucracy harder than stainless steel, as ZHU RONG JI said. so many people would suggest you retract the first one first.
