Under the current immigration law, only higher educational institutes, non-profit organizations related to the higher education or research organizations are exempt from the H-1B cap. Nonprofit organization unrelated to the education or research is not exempt from the H-1B cap. However, congress is currently working on a Bill for foreign graduates of Master or Ph.D. to be exempted from the H-1B cap. For more information, please see my website.
