Tax question, stp please help.

I am HI-b visa, my hu*****and is F-1. We came to USA in 2000. We want to file 1040 jointly, Is that OK for us since we have different visas? Can he also has 5000 Treaty for students?

My hu*****and has filed his state tax from internet, if we file Federal Tax jointly, Can we file state tax seperately? or we have to refile the state Tax jointly from internet for consistance.
