If Cap00 is a private figure and the concern is a private concern, there is no Constitutional issue and the applicable law is the common law, in which, general damage is PRESUMED and no proof of specific damage is required. The defendant has the burden to disprove the general damage by preponderance of evidence.

That's the law.
