绿卡告移民局批了,劳工却不肯撤诉

3个月前 file Writ of Mandamus ,过了一个月绿卡就批了,US Attorney General 的律师打电话要我们Dismiss case,劳工却不肯,他坚持要
移民局退回我们的申请费,要移民局道歉.对方律师 file motion to dismiss
劳工坚持要file motion to object dismiss.case 是我们是自己做的,要求就是 approve our case,我认为劳工没有任何成功率,他要折腾,
想问一下 法官会不会 直接 terminate the case even if LD filed motion to object to dismiss.对我们已经批的申请会有什么影响?有没有上庭的可能.
