请教法居士一个问题

I am J2 holder. My visa will be expired in half a year. I suppose to change to H1B with waiver.But my spouse is unwilling to give me the proof of waiver for some reasons. Do you know if I wanna stay in usa,how I can change my visa without going back to China on my own effort? Thanks a lot!
