The Re/Max should be paid after they collecte the rent, they take 10% off then give the rest to you. There is no reason you pay them ahead of the time. You should get the refund for the period which the renter did not pay the rent. It should be Re/Max's responsiblity to collect the unpaid rent.
By the way, who is your collection agency? I am looking for one now.
