Most of the cases, police doesn't tell which side is at fault. Even the cited driver may not be at fault 100%.
It is pure the insurance company's responsibility to make the judgement. If you don't agree with the adjustment, consult a attorney. Don't worry about how much the attorney might take, CARE how much you can get.
