No need to sue unless he does nto ahve enough coverage. Form what I can see, it is not the case.
Also, do not just buy liablity only. Buy enough comprehensive and under/uninsured coverage. A few hundreds doillars per year saves you a lot of headache. What if the driver was driving a stolen car?
No lawer will be interested in your case because the driver is a "poor" immigrant.
