遭遇车祸，恳请帮忙

Last friday, I met a traffic accident, my new car (2005, 3K miles) was damaged at the right side of the car. Not my fault. Then I called the other person's insurance company. The repair costs about 10K, and the total new car costs 19K. However, I do not want to repair it and do want get a brand new csar. How can I argue wih the insurance company?
