misleading by sales

builder's sales told us we can write a letter to builder to see if we can get a refund of our deposit when we back out the deal. So we emailed she "we hope release the contract and get back our deposit". But she emailed us "the full amount will be retained by builder and your purchase agreement cancelled as you requested". Cancelled? Our intention was to back out the deal on condition that ur doposit would be returned by builder. Our email was not a formal notice of cancellation; it was an inquiry for information.
How can I do now?
