That's not true. No state precludes children from tort liability. Some states require age of 7 and some require age of 4. Some state like California require no age at all. For example, if an new born scratches a nurse's face during delivery, he can be sued for battery. Infancy is not a defense for civil wrongs but a defense for criminal wrongs. On the other hand, sue parents/school for vicarious liability would never prevail because you can not prove cause of fact and proximate cause.
