check your purchase contract

Most contract have clause about such things. In the standard contract n Texas, the HOA fees should prorated between seller and buyer, so in thatcase, you are entitled to ask the seller to pay you back. But some seller, like most banks or property management company (for forclosed properties), they have addendem to tell you the buyer take responsibility in such case. So I recommend you check your contract again.
