Need legal advice on PI

It happened two years ago (09/01/03). One car hit our car from behind. I got injured and the medical cost was $2,700. The other party's insurance company only offered to pay $3,000. I didn't accept it. They told me you could file a lawsuit only after two years. Now they said we may not get the $3,000 back. Do you think we still have the right to file a lawsuit after two years?
