I don't think anyone here can say the judge will rule in your faver or not. But it's certainly worth a try, even in small claims court, both side will testify under oath, so if the other side is smart, he/she won't find committing purjery very funny. Purjery is MUCH more serious offense than a little accident. So drag his/her ass to small claims court and see if the other side has the guts to commit perjury.
