Labor certificate

I am now in H1B and wanna apply gc. My attorney told me she sent my case on 03/31/2005(b4 new rule) but I never saw INS' instruction to ask my company to advertise my position. When will INS give employer instruction after my case files? I am already in my second H1B. Thanks.
