It's required by the INS.
I have similar experience 2 years ago. INS rejected
my first application and asked for my lastest paystub.

So legally you can not tranfer youe H1-B cause there
is a gap between your two job. But sometimes it may
be OK. I think you need to find a lawer to prepare
your application.
