请教单身老猫

My hu*****and forced me to sign an very unfair agreement last yr with dirty tricks. However, in the agreement, he was surposed to pay me 5000 bucks within 6 mon.s, and he's failed to. Now 6 mon.s passed I asked him again he said he won't. Now as my health is worst and worst, he is more and more evil, divorce is inavoidable. I wonder:

1.can i set aside that agreement when we divorce later since he fails to abide the agreement first?

2. I am in AL,USA, i got some printed emails he flirts on line with other girls, are they useful to against him for my divorce?
