You can try

Look, if this is their first time being late, no judge would allow eviction.  If they are always late, some judge might allow.

Also, they complaint that their dog died, if you evict despite they tried to pay, judge might rule that this is retaliatory eviction.  

Just use common sense.  Don't be a jerk.
