No, he filed 485 first. his company filed everything for him. So he didn't let his immigration attorney know about it. He suspected that INS never got his dismiss report from the court. But they (who? the INS or you friend) did receive FBI record.

I have a friend had a same case, but got dismiss from court, and he do not got record in FBI when he check his record from FBI. so his I485 has no problem
