As a CPA, I will say it is illegal.
In the case as you mentioned, it definitely violates the definition of "dependent" in the tax code.

I agree that a lot of Chinese (in fact not only Chinese) do take this kind of risks, however, if IRS do figure out the fraud. The punishment will be a lot.
