Sue and Dispute

You can sue the other driver whether he/she has insurance or not. Consult a lawyer for this.
If your insurance UMPD is limited at $3500, then that's it. Otherwise, you can dispute with your insurance company about the market value. If you suffered personal injury, you can make a claim on that.
