In theory, either party may file a suit for divorce. But the matrimonial law varies from state to state. The requirments for divorce may also be different. Just consult a local attorney practicing family law. If you have become a resident of NY state for over 2 years, you may bring the suit in the matrimonial court in the county where you reside.
