take a close look at

the disclaimer/notice/warnings/release/ or the like document, the clinic asked you to read and/or sign before the operation. If they warned you of the possible risk and you were still willing to proceed, you may not have a case. If they assured you that there was no such risk, whether in writing or orally, congradulations, you may have a medical malpractice lawsuit.
