age discrimination？

LD 50 多了。 在一大公司多年了。  他说近两年公司的小老板在他面前说： "it is good to have a job at your age", 或者 “at your age, it doesn't matter if you do exercise or not", 或 在背后同其他同事讲 “I think he is going to retire...".  有一次他火了， 就正式写email 给其中一位说你必须 stop doing these. 公司上层也知道了此事，但大家都不愿意出面解决。我告他说你可以告公司 age discrimination, 但他觉得不愿意就此跟公司对立， 也怕case not strong enough.  也没主意了。 想听听这里专家的意见。 谢了。
