老猫请进。warrant issue

美国纽约州给俺的朋友下了，criminal warrant 。
其实就是俺朋友的identity被别人盗用了等等事。charged with fraud。
俺问了律师
It is my experience that nothing can be done on your behalf until the warrant has been served.  If you have no intention of coming back to the US then it is likely that the warrant will never be served.  Please keep in mind that having an open warrant may affect international travel.  
我理解为如果没有抓到俺朋友就没有事情。如果不来美国就基本不会被抓到。

如果我朋友不服气。是否可以请美国律师来打官司。我朋友不来美国。
如果要打官司，我朋友是否必须先到美国，get arrested first. 然后保释等等，再在法庭打官司吗？
