我有一租客,2013年五月一号住进去,租约是一年,到4月30号到期,每月一号交租;但如双方在合约满一年的前30天不给通知,合约就自动续下一年。满一年前我口头问过他们,他们说再住一年,所以租约应到今年4月30号到期。合约是这样写的。
3. Renewal: Either party may terminate this Lease at the end of the term by giving the other party thirty (30) days of notice prior to the end of the term. If neither party gives notice of termination, the Lease will automatically renew for an additional period of twelve months upon the same terms and conditions as stated herein.
今年1月2号,打电话告诉我他们要在1月31号搬走,搬到离朋友近的地方。他们交租还准时,人也不错,我就想努力挽留他们。说如他们4月30号后还租,我就给他们每月减免80块钱,还可以商量,言下之意他们决意要走,我也让他们在1月31号搬走。到1月31号前没给任何回复,我还以为他们会继续租。
1月31号没动静,到了2月2号也没交租,打电话不接。2号晚上接了,说要2月7号搬并交还房子,我说好,但要帮我搞好房子卫生。我以为会很平和的了了。到了7号,我打了无数电话,不接或按断。我没办法,用电邮给他们发了要他们交租或搬走的通知,然后接着打电话,这才接,并说8号还房。8号拿回房子时,发现他们并没搞卫生,全屋的墙上到处是污迹,还在屋里抽烟,很重的烟味,满屋的狗毛,猫毛。我当时就告诉他们卫生和墙的两个问题。他们有1000块压金在我手里,包括200的宠物压金。我想就拿1000块抵2月份的租金和搞卫生,刷墙的所有费用,其它不追究了。把他们想太好了。
11号发电邮要我还压金,不然就找人告我. 当时来租我房时,告诉过我他们在告前房东,因为房东不修东西,屋子长霉,导至那老婆有健康问题。他们是低收入家庭,也许有免费的attorney帮他们,从前房东那讹到了些钱,尝到了甜头。

我想问我应拿着这清单主动出击,还是等着接他们的招。他们不肯给新地止,我就是要主动出击,也不知往哪送件。请教老猫等各位,我该如何应对他们。
