到底谁要告你？下次不要这样浪费时间

是网上的匿名甲，网上的匿名乙，还是现实生活中的陆美丽？名字写错应该不影响对方的案件，如果你说“卢”美丽和别人乱搞男女关系，名字拼错，但是读者都知道你在说谁，诽谤照样成立。

第一，诽谤不是罪，而是民事纠纷（虽然违法，比如违反合同违法但不是罪）。

第二，诽谤罪是否能够成立，一般有四个条件（各个州略不同）同时成立：（google "elements of defamation")
（1） a false statement purporting to be fact concerning another person or entity;
你能不能证明你的言论是真实的？如果言论没有错误，这个案子马上不成立。

（2） publication or communication of that statement to a third person;
这条已经成立；

（3）fault on the part of the person making the statement amounting to intent or at least negligence; and
如果你搞错，你应该有疏忽。

（4）some harm caused to the person or entity who is the subject of the statement.
这个对方很难证明，如果你诽谤人家职业名声或者性生活，法院假设伤害。除此之外，原告需要证明确实的伤害。你这个案件，即使其他因素成立，对方应该很难证明伤害（你是诽谤陆美丽诽谤你），最多大不了￥1象征性的赔偿。

所以你应该洁身自好，但是不用担心。下次不要这样浪费时间。
