Can I sue this mechanic?

I bought a used BMW318ti a few days ago. I did a used vehicle pre-purchased inspection by mechanic and everything turns out to be fine. Today BMW dealership service dept. technician told me the transmission slip. It costs US$3,500 to replace it. Can I sue the previous mechanic for the failure to identify this major problem? Thanks.
