Your best course would be to file a divorce in California and wait out the judicial cooling period. You are correct that a Chinese divorce during this period would be meaningless. If you remarry then you run the risk of not only your later marriage could be nullified but also a crime of polygamy. Polygamy in California is a crime of third degree felony under California Penal Code 281. Your good faith belief will not be a defense in such a case.
