Court cannot help you investigate. You need to investigate yourself and prove his income. His lack of income, however, is not an excuse to pay for child support. Any modification of the child support must be approved by the court. You can file a motion for contempt since he is in arearage of the child support. You can also hire a private investigator in china to prove his income but that is a far stretch. You can also file a motion to terminate his parental rights. Do not know which state you are in. In California, for example, a judge can terminate a party's parental right if the party fails to visit or contact the child for 6 months and the judge finds it is in the best interest of the child to terminate the right and not to offer reunification.
