is this legal? more details

1. My kid is 17, still in high school. He will be 18 by next summer.

2. We are now in NC. My hu*****and is in China.

3. I will be in New Mexico.

So, the question is: can I leave him behind in NC until he goes to college? If not legal now, can we do it when he reaches 18?
