这合同还有效吗？

我们和一私校签了一年的合同（２０１１－２０１２），最近想退出，但私校坚持要我们承担该学年学费（合同上是有这条）。

我们可争辩的有两条吧。

１） 合同中一contingency提到５月２７号， ２０１１之前要交＄１０００, 具体文字如下：The school's acceptance of Student for enrollment is contingent upon both Financially Responsible Parent(s)/Guardian(s) executing this Contract and returning it to the School on or by May 27, 2011, along with the new student deposit in the amount of $1000. 但我们是５月２７号签的合同，６月９号才寄出check，他们６月14号ratify的。

２） 合同上有一取消日期，是５月３１号，但根据６月14才ratify的，该日期根本不合理，使我们无法取消合同。

所以， 请教各位律达人，我们能根据此两项说合同无效吗？多谢。
