老猫请教,押金不拿,合同就没有终止吗?
房屋买卖合同中有一条款写明:
12 PURCHASER'S DEFAULT:
In the event that the Seller is able to comply with the terms of this
contract and the Purchaser is in default and/or willfully refuses to close
title, all payments hereunder shall become the sole property of the Seller,
as and for liquidated damages and not as a penalty, and the Purchaser shall
have no further claim thereto, and thereupon this contract shall be deemed
at an end and shall become null and void.
如果在这种情况下买方退出合同,损失押金的情况下,买方有没有可能通过lawsuit
来强迫买方购买此房吗?
卖方律师讲他们可以不拿押金,那么说合同就等于没有终止,然后再通过官司来强制
执行合同,不知有没有道理,胜算多大,谢谢!
