Found termite problem right after COE

We just closed escrow on a house few days ago. We noticed termite problem today, which is in an area that was clearly covered up but not disclosed on the termite report.

I have collected termite sample in a clear plastic bag and took some pictures. I also ask the termite company to come take a look tomorrow.

What should we do? Should the owner be responsible for repair?
