I can't see anything from my unit. That crack(in downstairs unit) is exactly under the bath tub. And I can guarantee that my bath room never has leaking problem.

I guess HOA believe the plumbing pipe in between the two unit leaking. It's possible cause it's built 30 years ago. But that area should belong common area. HOA should takes care of it. HOA just don't want to check/repair it. I just need to know how to deal with them legally.
