No. The atternoy will get 5/3 = 1.66. You will get 3.33 - 2 = 1.33. However you don't need to pay back medical expense to your auto insurance ( if you medical was covered by your auto insurance ). You do need to pay it back to your medical insurance company if it was covered by it. The above was based on NJ law.
