If contract allow the buyer using loan as contigency, you have to allow the buyer terminate contract. But you may sue the lender who did the pre-approval.

If you did not have a pre-approve letter, you may sue your real estate agent that he/she did not gave you reasonable advise to request a pre-approve letter before sign a contract.
