can't request c-sec before 39 weeks

Just learned from my OB today that I can't request c-sec before 39 weeks. I had c-sec 5 years ago at 38 weeks, now I am much older and worried about complication of vbac if I can't wait till 39 weeks. Are there any jm who had c-sec and then vbac?
