all the legal documents need to be clear that both own the property or any assets.  I had a colleague who lived with her ex-BF for 11 years.  They bought a lot of things together, but under the guy's name.  One day, that guy had a heart attack on his way to work.  My colleague went to claim the property only to find that his kids automatically inherited all of them, including the car she bought for him.  When she went to claim the Social Security money, she was told that she was not qualified coz her annual income from the year before exceeded the maximum limit to claim the money.  She later moved to Florida to stay with her daughter.
