我朋友两口子当年H1b签证，递交了NIW，140都通过了，由于家里是独子，没有递交485
就回国了（十多年前了），到现在他们家也没有撤销自己的移民申请。当时儿子已经出
生，现在儿子面临上初中了，孩子的母亲（当时持有H4）想陪他来美国读初中（孩子是
在美国出生的），像这样的情况孩子的母亲怎么来美国？申请旅游签证有可能吗？谢谢。

-Based on the new immigration law, if you do not file I-485 or apply for mmigrant visa witnin one year from the date when your priority date becomes crrent, the I-140 will be void. So, The approved I-140 probably has been void. 

She can apply for B2 visa to visit US temporarily, but it is nearly impossible for her to stay in US for a long term to accompay her kid to study in US unless she finds a job in US (e.g., as a H-1b holder).
