我身份是L2，我夫人身份是L1，都是9th May 2017到期

我夫人申请了L1延期，我想提交I-539转身份到F1，已经拿到学校的I-20

我有两个问题

1）学校I-20表program start是20th June.2017，我的L2 exp是9th May.2017 这中间有42天的GAP。我是否可以使用Grace period 60days (DHS 2017 Final Rule to grant 60 days H1B Grace Period & Other Benefits)

-There is not grace period for L-1 or L-2. But if you file I-539 before May 9, you can legally stay in US during the I-539 pending, and you can start your study in the school during the change of status pending, but you cannot work on campus until F-1 status is approved.

2) 我夫人在2016年10月申请了EB-5，提交了I-526，我夫人是主申请人，我是家属。目前I-526的状态是pending。I-539表中part4 item4 Has an immigrant petition ever been filed for you or for any other person included in this application? 我是应该选YES，还是NO？
