Yes, some J1 got their F1 without waiver, just simplely because INS made some mistakes (you can image how many cases they are handling everyday and how many mistakes they could make). But that don't mean the law has changed and same mistake will apply to everyone.

J1 need a waiver before changing to anyother visa status or GC, maybe B1/2 could be an exemption. Especially for PRC passort holder, all J1 need a waiver no matter what is annotated on the visa and DS-2019. This is based on Sino-US treaty regarding J1 issue.
